Terms of Service

• DeadEven is a golf side-game scoring and betting-round tracking app.
• The Service helps groups of golfers organize rounds, track hole-by-hole results, and calculate side-game outcomes (such as Wolf, Nassau, High-Low, and Skins).
• DeadEven is a scorekeeping and social golf tool.
• DeadEven does not operate as a casino, sportsbook, or real-money gambling platform.
• We do not accept wagers, hold stakes, or pay out cash winnings.
• Any monetary amounts shown in the app (for example, unit bets or standings) reflect informal agreements among players in your group.
• You are solely responsible for complying with applicable laws in your jurisdiction regarding private golf games and any real-world money exchanged outside the app.

• You must be at least 13 years old (or the minimum age required in your country to consent to data processing, if higher) to use the Service.
• If you are under 18, you represent that you have permission from a parent or legal guardian.
• You may not use the Service where prohibited by law.
• You are responsible for ensuring your use is lawful in your location.

• You must provide accurate account information and keep it up to date.
• You are responsible for safeguarding your login credentials and all activity under your account.
• Notify us promptly at support@deadevenapp.com if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms or pose a security or legal risk.

4.1 Free tier

• DeadEven may be used without a paid subscription.
• Free users may receive a welcome allocation of virtual “TeeCoins” and can join rounds hosted by others at no TeeCoin cost.
• Hosting new rounds may require spending TeeCoins according to the in-app pricing shown at the time of creation.

4.2 TeeCoins

• TeeCoins are a virtual in-app currency with no cash value.
• TeeCoins are not redeemable for money and cannot be transferred to other users.
• TeeCoins are non-refundable except where required by applicable law or the policies of Apple App Store or Google Play.
• We may modify TeeCoin pricing, grants, or earning methods (including promotions, ads, or referrals) at any time.

4.3 Unlimited Membership (subscription)

“Unlimited Membership” is an auto-renewing subscription that provides the benefits described in the app and store listing at the time of purchase, which may include unlimited round hosting without TeeCoin charges and other premium features.

Current subscription options (prices may vary by region and store):

• Unlimited Monthly — billed every month (currently $6.99 USD in the United States).
• Unlimited Annual — billed every year (currently $66.99 USD in the United States).

Payment

• Purchases are processed by Apple (App Store) or Google (Google Play), not directly by Productos ORTVIL, S. de R.L. de C.V.
• By subscribing, you also agree to the applicable store’s terms.

Auto-renewal

• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
• Your store account will be charged for renewal within 24 hours prior to the end of the current period.

Manage or cancel

• Apple: Settings → [your name] → Subscriptions → DeadEven
• Google Play: Play Store → Profile → Payments & subscriptions → Subscriptions → DeadEven

Other subscription notes

• Deleting the DeadEven app does not cancel your subscription.
• You may use “Restore Purchases” in the app to recover entitlements on a new device, subject to store rules.
• Unless explicitly offered in the store listing at checkout, Unlimited Membership does not include a free trial.

You agree not to:

• Use the Service for unlawful, fraudulent, or harassing activity.
• Attempt to reverse engineer, scrape, or disrupt the Service or its infrastructure.
• Upload content that infringes others’ rights or contains malware.
• Impersonate another person or misrepresent your affiliation.
• Circumvent paywalls, virtual currency limits, or subscription checks.
• Use the Service to facilitate illegal gambling or money laundering.

• You may submit information such as display names, profile photos, course names, scores, and round data (“User Content”).
• You retain ownership of your User Content.
• You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process User Content solely to operate and improve the Service.
• You are responsible for User Content you submit and for obtaining any permissions required from other players you add to a round.

• The Service, including the DeadEven name, logo, design, and software, is owned by us or our licensors and is protected by intellectual property laws.
• These Terms do not grant you any right to use our trademarks except as necessary to use the Service in accordance with these Terms.

• The Service relies on third parties such as Supabase (authentication and data storage), RevenueCat (subscription management), and Apple/Google (billing).
• Your use of those services may be subject to their separate terms and privacy policies.
• We are not responsible for third-party services outside our reasonable control.

• THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
• TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• We do not guarantee uninterrupted, error-free, or perfectly accurate scoring or standings.
• You are responsible for verifying results that matter to your group.

• TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
• OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You agree to defend, indemnify, and hold us harmless from claims arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

• You may stop using the Service at any time.
• We may suspend or terminate access if you breach these Terms or if we discontinue the Service.
• Sections that by nature should survive (including payment obligations incurred through stores, disclaimers, limitations of liability, and indemnification) will survive termination.

• We may update these Terms from time to time.
• We will post the revised Terms on our website and update the “Last updated” date.
• Material changes may also be communicated in the app.
• Continued use after changes become effective constitutes acceptance of the revised Terms.

• These Terms are governed by the laws of Mexico, with specific application to the State of Jalisco, without regard to conflict-of-law principles.
• Mandatory consumer protection laws in your country or state of residence may apply where required by law.
